Waiver / liability release

Release of Liability and Assumption of Risk

This Release of Liability and Assumption of Risk Agreement ("Agreement") is entered into by and between Atlanta Judo Midtown LLC ("AJM"), located at 2213 Faulkner Rd NE, Atlanta, GA 30324, and {name} ("Participant").

1. Assumption of Risk

1.1 Voluntary Participation: The Participant desires to participate in activities provided by AJM, including but not limited to Judo, Brazilian Jiu-Jitsu (BJJ), Jujitsu, weight lifting, rope climbing, and stunt training ("Activities").

1.2 Awareness of Risks: The Participant acknowledges and understands that the Activities involve the risk of injury, death, and property damage. The Participant voluntarily accepts and assumes all risks associated with the Activities, whether caused by the negligence of AJM or otherwise.

2. Waiver and Release

2.1 Release of Claims: The Participant hereby expressly waives and releases any and all claims, now known or hereafter known, against AJM, its owners, instructors, employees, agents, affiliates, and volunteers, including R. Matthew Scheib and Dennis R. Scheib, as well as USA Judo and their affiliated clubs (collectively, "Releasees"), on account of injury, death, or property damage arising out of or attributable to the Participant's participation in the Activities, whether arising out of the negligence of the Releasees or otherwise. The Participant agrees not to make or bring any such claim against the Releasees and forever releases and discharges the Releasees from liability under such claims.

2.2 Indemnification: The Participant agrees to indemnify and hold harmless the Releasees from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of the Participant's involvement in the Activities and to reimburse the Releasees for any such expenses incurred.

3. Inspection and Responsibility

3.1 Inspection of Facilities: The Participant acknowledges their responsibility to inspect the mats, equipment, and facilities to be used before participating in the Activities. If the Participant believes anything is unsafe or beyond their capability, they will immediately inform their coach, instructor, or supervisor and refuse to participate until such conditions are corrected.

3.2 Compliance with Rules: The Participant agrees to familiarize themselves with the rules governing the Activities and understands the importance of following these rules to ensure their safety and the safety of others.

4. Additional Provisions for Minor Participants

4.1 Parental Consent: If the Participant is a minor (under the age of 18), the parent(s) or legal guardian(s) of the minor Participant acknowledge that they have read and understood the terms of this Agreement and consent to the minor’s participation in the Activities. The parent(s) or legal guardian(s) agree to instruct the minor on the terms and conditions of this Agreement and their ramifications.

5. Publicity Release and Waiver

5.1 Use of Likeness: The Participant grants AJM the irrevocable right to use, display, photograph, digitize, edit, adapt, license, or otherwise use their name, image, likeness, appearance, voice, and other personal characteristics in any media, including but not limited to magazines, brochures, print publications, motion pictures, television broadcasts, internet platforms, and other advertising and promotional materials, without further consent from or royalty, payment, or other compensation to the Participant.

5.2 Ownership of Materials: AJM shall be the exclusive owner of all rights, including copyright, to these materials.

6. Acknowledgment of Understanding

6.1 Reading and Understanding: The Participant acknowledges that they have read this Agreement, understand its terms, and that they are giving up substantial rights by signing it. The Participant signs this Agreement voluntarily and agrees to participate in the Activities entirely of their own free will, fully aware of the risks and conditions involved.

Additional Terms/Fees

Background Checks (21+): AJM strives to be a safe space for all students to train. To do this, we require current background checks for all monthly members 18 years of age or older. A background check must be completed through USA Judo within 14 days of sign-up. Only serious crimes of moral turpitude will preclude someone from membership at AJM. All results are kept confidential, and background checks from other entities cannot be accepted. Check your welcome email or stop by the front desk for instructions on how to get your background check.

CC Processing Fee: Small business costs continue to increase (rent, utilities, accepting card payments, and more). We want to provide you with the best experience, and also need to cover our operating costs by charging a small 2.5% fee with cards. If you’d like to bypass the credit card fee, you are welcome to link directly to your bank account for direct debit for no additional fee. To do this, go into your profile and select billing > payment methods > add a payment method > bank debit. To do this during sign up, click pay later, then follow the above instructions. You will not be able to check in for class until your first payment is processed.

Judo Gis: A Gi is required to train at AJM, and prices vary by size and brand. Gis are not mandatory during the 2-week trial. Talk to our front desk about our Gi options in-house or where to find one online.
